AI Abuse Policy

This AI Abuse & Acceptable Use Policy ("Policy") is effective as of May 5, 2026 and governs the use of the services provided by Gioconda AI. ("Company," "Provider," "we," "us," or "our").

This Policy applies to all users, customers, clients, partners, and any individuals or entities accessing or utilizing the Company's artificial intelligence systems, communication tools, and related services (collectively, the "Services").

By accessing or using the Services, you agree to comply with this Policy.

1. Purpose and Intent

The purpose of this Policy is to establish acceptable standards of conduct and usage for AI-powered systems that facilitate communication, automation, and transactional workflows.

Due to the nature of AI systems - particularly those capable of generating human-like communication, initiating interactions, and facilitating transactions - the Company has implemented this Policy to:

  • prevent misuse and abuse of AI capabilities
  • protect individuals and organizations from harm
  • ensure compliance with applicable laws and regulations
  • preserve the integrity, security, and reliability of the Services

This Policy shall be interpreted broadly to prohibit any activity that undermines these objectives.

2. Scope of Application

This Policy applies to all use of the Services, including but not limited to:

  • AI-generated voice communications
  • SMS, messaging, and chat-based interactions
  • automated outbound and inbound communications
  • AI-assisted scheduling, routing, and workflow automation
  • AI-facilitated transactions and payment-related interactions

This Policy also applies to any third party acting on behalf of a user, including employees, contractors, or agents.

3. General Standard of Use

Users are expected to use the Services in a lawful, ethical, and responsible manner.

Users shall not use the Services in any way that:

  • violates applicable laws or regulations
  • infringes upon the rights of others
  • causes harm, deception, or disruption
  • exploits the capabilities of AI systems for improper purposes

The Company reserves the right to determine, in its sole discretion, whether any use of the Services violates this Policy.

4. Prohibited Uses

The following activities are strictly prohibited.

4.1 Unlawful Activity

Users shall not use the Services to engage in or facilitate any unlawful activity, including but not limited to:

  • fraud, deception, or misrepresentation
  • unauthorized financial transactions
  • violation of consumer protection laws
  • unlawful solicitation or marketing practices

4.2 Unauthorized Communications and Consent Violations

Users shall not initiate communications through the Services without obtaining all legally required consent.

This includes, but is not limited to:

  • placing automated or AI-generated calls without proper authorization
  • sending unsolicited SMS or messaging campaigns
  • violating the Telephone Consumer Protection Act (TCPA), CAN-SPAM Act, or similar laws

Users are solely responsible for ensuring that all communications comply with applicable laws.

4.3 AI Manipulation and Prompt Injection

Users shall not attempt to manipulate, override, or exploit AI system behavior through adversarial or deceptive inputs.

Prohibited actions include:

  • injecting malicious or misleading prompts designed to alter AI behavior
  • attempting to bypass safety controls or restrictions
  • inducing the AI to produce prohibited or harmful outputs

4.4 Impersonation and Deceptive Practices

Users shall not use the Services to impersonate any individual, organization, or entity.

This includes:

  • falsely representing identity, affiliation, or authority
  • using AI-generated communication to deceive or mislead recipients
  • conducting social engineering or impersonation attacks

4.5 Financial Misuse and Transactional Abuse

Users shall not use the Services to engage in improper or unauthorized financial activity.

Prohibited conduct includes:

  • initiating transactions without proper authorization
  • attempting to manipulate or exploit payment workflows
  • conducting fraudulent billing or charge activity

4.6 Harmful, Abusive, or Offensive Content

Users shall not use the Services to generate or distribute content that is:

  • threatening, harassing, or abusive
  • discriminatory or hateful
  • violent or promoting harm
  • exploitative, including sexual exploitation or abuse

4.7 Privacy Violations

Users shall not use the Services to collect, process, or disclose personal information in violation of applicable privacy laws.

This includes:

  • collecting personal data without consent
  • sharing confidential or sensitive information improperly
  • engaging in doxxing or identity exposure

4.8 System Abuse and Interference

Users shall not attempt to disrupt or interfere with the operation of the Services.

Prohibited actions include:

  • attempting to hack or compromise systems
  • overloading or abusing system resources
  • reverse engineering or extracting proprietary models

5. High-Risk and Restricted Use Cases

Certain use cases present elevated risk and may be restricted or require prior approval.

These include, but are not limited to:

  • medical or healthcare-related decision-making
  • legal or financial advisory services
  • emergency response systems
  • high-volume outbound communication campaigns
  • cross-border or complex financial operations

The Company reserves the right to approve, restrict, or prohibit such use cases at its sole discretion.

6. User Responsibilities

Users are solely responsible for:

  • ensuring lawful and compliant use of the Services
  • verifying AI-generated outputs before acting on them
  • supervising and monitoring AI interactions
  • maintaining accurate records of communication consent
  • safeguarding account credentials and system access

The Company does not assume responsibility for user actions conducted through the Services.

7. AI System Limitations

Users acknowledge that AI Systems:

  • operate based on probabilistic models
  • may produce inaccurate, incomplete, or misleading outputs
  • may misinterpret user intent or context

Users agree that:

All decisions and actions taken based on AI-generated outputs are made at the user's own risk.

8. Monitoring and Detection

The Company reserves the right to monitor usage of the Services to detect violations of this Policy.

Monitoring may include:

  • analysis of interaction patterns
  • detection of abnormal or high-risk behavior
  • identification of misuse or abuse scenarios

Such monitoring is conducted to maintain system integrity and compliance.

9. Enforcement and Remedies

In the event of a violation of this Policy, the Company may take any action it deems appropriate, including but not limited to:

  • issuing warnings
  • suspending or restricting access
  • permanently terminating accounts
  • withholding or restricting services
  • reporting unlawful conduct to appropriate authorities

The Company may take such actions without prior notice where necessary to prevent harm or mitigate risk.

10. Reporting Violations

Users are encouraged to report suspected violations of this Policy.

The Company will review all reports and take appropriate action at its discretion.

11. Indemnification

Users agree to indemnify and hold harmless the Company from any claims, damages, liabilities, and expenses arising out of:

  • violation of this Policy
  • misuse of the Services
  • unlawful communications or transactions
  • harm caused to third parties

12. Modifications

The Company reserves the right to modify this Policy at any time.

Continued use of the Services after any modification constitutes acceptance of the updated Policy.

13. Relationship to Other Agreements

This Policy is incorporated by reference into the Company's Terms and Conditions and Master Service Agreement.

In the event of a conflict, the stricter provision shall apply.
